The petitioner seeks bail in Yogapatti P.S. Case No. 349 of 2018 instituted for the offence under Sections 447, 143, 447, 448, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has clean antecedent. He is in custody since 31.7.2018. In the written report it is alleged that this petitioner assaulted husband of the informant namely, Fulena Yadav with Garansa, on account of which, he sustained injury. The injury report of Fulena Yadav has been enclosed as Annexure-3 series wherein the Doctor has found six injuries,

From the First Information Report it appears that both parties are co-villagers. The instant case is counter blast of Yogapatti P.S. Case No. 336 of 2018 filed against the informant and others.

Counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, in connection with Yogapatti P.S. Case No. 349 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
