Mr.Harendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner apprehends his arrest in connection with Patori P.S. Case No. 190/2019 registered for the offences punishable under Sections 120B, 34, 406, 409 and 420 of the Indian Penal Code.

Petitioner was working as Branch Manager and he credited the sanctioned loan amount in the account of coaccused instead of crediting the said amount in the account of petitioner.

The record goes to show that on 22.6.2020 adjournment was sought on behalf of the petitioner on the ground that the petitioner shall bring the relevant documents on

Patna High Court CR. MISC. No.68486 of 2019(6) dt.06-10-2020 2/2 record to show that on the request of the informant, the loan amount was credited in the account of co-accused but the petitioner failed to bring any document on record to show the above stated fact.

Regard being had to the facts and circumstances as well as submissions of the parties, I do not think it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
