The petitioner seeks regular bail in connection with Sasaram Rail P.S.Case no.72 of 2018, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 and Section 25(1-b)a, 26 and 35 of the Arms Act.
Allegation against the petitioner is about recovery of one loaded pistol and two cartridges and also other articles. Submission of the learned counsel for the petitioner is that he has no criminal antecedent and he has been falsely implicated in this case. He is in custody since 18.7.2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.68080 of 2018(2) dt.30-11-2018 2/2 circumstances, as stated above, this application is disposed of with direction that once the charge is framed or the petitioner remain in judicial custody for six months whichever is earlier, he shall be released on bail in connection with Sasaram Rail P.S.Case No.72 of 2018 by the learned court below on filing undertaking that he will co-operate in disposal of the trial. With the aforesaid observation, this application is disposed of.
