Petitioner apprehends his arrest in a case registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Informant who is the police officer has alleged in his written complaint that on specific information that Umesh Mahto and Vinod Mahto are indulged in trade of illicit liquor. Their house was raided and wife of Umesh Mahto Sunita Devi was arrested with illicit liquor in her possession and same was recovered from the bag. However, petitioner and his brother managed to flee away. There is recovery from the house of petitioner, as such, anticipatory bail application is not maintainable and is accordingly dismissed.

Petitioner is directed to surrender before the court

Patna High Court CR. MISC. No.75810 of 2019(3) dt.06-01-2020 2/2 below within six weeks from the date of order and make prayer for regular bail, and if he does so, the court below will hear the bail application of the petitioner and dispose it of on the same day, without being prejudiced by this Order.
