Petitioner seeks bail in Balthar P.S. Case No. 52 of 2018 registered for the offences punishable under Sections 363/365/366/376/34 of the Indian Penal Code. The informant has alleged that on assurance of marriage petitioner established illicit relation with her and kept her in his house. Thereafter, the petitioner and his family members assaulted her and ousted from his house. It has been submitted on behalf of the petitioner that he has not committed any offence as alleged in the F.I.R. and he has falsely been implicated in this case. It has further been submitted that the informant is major and there is no allegation of doing anything against her will or without her consent. Petitioner has got no criminal antecedent and is in

Patna High Court Cr.Misc. No.68340 of 2018(2) dt.30-11-2018 2/2 custody since 21.08.2018.

Learned counsel for the informant has opposed the bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- VII, Bettiah, West Champaran in connection with Balthar P. S. Case No. 52/2018 with following conditions:- (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
