The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 354, 353 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner along with 5-6 persons surrounded the informant at the gate of her office and slapped the informant and also snatched her earring, nose pin etc.

It is submitted that at the relevant time petitioner was Mukhiya and the informant was working as a contractual employee at Piprakothi Block. She was not cooperating the petitioner in his official work, so the petitioner complained against the informant to the Block Development Officer, Piprakothi, who found her guilty. Thereafter, at the instigation of

Patna High Court CR. MISC. No.73117 of 2022(3) dt.22-06-2023 2/2 former Mukhiya, the informant lodged the false case against the petitioner. The other allegations are super-addition to make the case grave.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Piprakothi P.S. Case No. 05 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
