JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Bhabua (Sonhan) P.S. Case No. 466 of 2008 for the offence under section 364(A)/34 of the Indian Penal Code.

The FIR was lodged against unknown.

The victim in his statement under section 164 Cr.P.C. has not named the present petitioner. The name of the present petitioner was disclosed by one Shankar Yadav. Said Shankar Yadav was granted bail on 8.5.2012 in Cr. Misc. No. 11238 of 2012.

Having regard to the fact that co-accused Shankar Yadav was granted bail by this Hon'ble Court in Cr. Misc. No. 11238 of 2012 vide order dated 8.5.2012, I am inclined to enlarge

Patna High Court Cr.Misc. No.20680 of 2017 (5) dt.07-06-2017 2/2 the petitioner, named above, on bail on the ground of parity as the case of the petitioner is similar to the case of co-accused Shankar Yadav who was granted bail on 8.5.2012 in Cr. Misc. No. 11238 of 2012 on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Kaimur at Bhabua, in connection with Bhabua (Sonhan) P.S. Case No. 466 of 2008, G.R. No. 1765 of 2008 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, influence the evidence or the witnesses.
