Earlier prayer for anticipatory bail was allowed vide order dated 13.07.2018 passed in Cr. Misc. No.30440 of 2018 provisionally for a period of six months on the condition that the petitioner shall deposit the rest of the amount in equal installment of Rs.1/- lac in the first week of alternative months and only after payment of full amount of Rs.4,32,000/-,the court below shall confirm the provisional bail of the petitioner, otherwise, he is free to pass any order/orders as he deems fit and proper.

Now an application has been filed for modification of the aforesaid order stating that as the installment amount has been fixed Rs.1/- lac, the petitioner seeks for reducing the same

Patna High Court Cr.Misc. No.66625 of 2018(2) dt.28-11-2018 2/2 to Rs.50,000/-.

In such view of the matter, considering the fact I am not inclined to interfere with the earlier order and in the facts and circumstances of the case I am not ready to change the amount of instalment, so fixed earlier, and, accordingly, the petitioner is directed to deposit rest of the amount within a period of four months from the date of receipt / production of a copy of this order, thereafter provisional bail of the petitioner shall be confirmed otherwise it be canelled.

With the aforesaid, this modification application stands disposed of.
