The petitioner seeks bail in Raxaul P.S. case No. 293 of 2016 under Section 461, 379 of the Indian Penal Code. Later on Section 411 of the IPC was added.
The informant lodged the case against unknown for theft in his electronic shop. It appears that during the course of investigation one Chandan Kumar was apprehended and he confessed his guilt and disclosed the name of Rahul Das, Ashish Kumar Mishra, Raj Kishore and Lavkush, the petitioner. In pursuance of confessional statement of Chandan Kumar stolen articles were recovered from the house of petitioner. The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.18761 of 2017 (2) dt.26-04-2017 2/2 petitioner is uncle of Golu, who is alleged to have committed theft and concealed the theft articles in the house of petitioner. The petitioner has got no criminal antecedent and he is in jail since 17.12.2016.
Considering the facts aforesaid and the fact that petitioner has already remained in jail for more than four months and he has got no criminal antecedent, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Raxaul, East Champaran at Motihari in Raxaul P.S. Case No. 293 of 2016.
