2. The petitioner apprehends his arrest in connection with Naugachia P.S. Case No. 213 of 2024 registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

3. As per the prosecution case, when the informant was sleeping with her children, the petitioner along with coaccused, committed theft of a box containing jewellery and cash from her house.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner and informant are neighbour, petitioner is a young boy aged about 20 years and save and except suspicion

Patna High Court CR. MISC. No. 72809 of 2024(2) dt.23-10-2024 2/2 no incriminating article has been recovered from possession of the petitioner. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation.

5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Naugachia P.S. Case No. 213 of 2024, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
