2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 115(2), 126(2), 109, 303(2), 352 and 3(5) of B.N.S.

3. The case of the prosecution is that 18 accused persons named in FIR along with 5-6 others being armed with lathi, danda, farsa, arms and iron rod arrived at the door of the informant and started abusing him. Specific allegation is against this petitioner is that when Ramchandra Yadav came to rescue the informant then this petitioner and one Dinkar Kumar assaulted with lathi and rod on the head of brother of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the injury report, it is clear that Ramchandra Yadav has received simple injury. It has further been submitted that co-accused Dinkar Kumar has already been granted anticipatory bail by learned co-ordinate Bench of this Court vide order dated 23.09.2025 in Cr. Misc. No. 63901 of 2025. The case of this petitioner stands on similar footing. Moreover, he is languishing in judicial custody since 12.08.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Madhepura P.S. Case No. 373 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura.
