2. The petitioner has preferred this application for grant of regular bail in connection with Beldaur P.S. Case No. 178 of 2021 dated 13.8.2021 registered for the offence punishable u/s 147, 148, 149, 342, 120B, 307, 302, 504 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, On 12.08.2021 at about 1:00 A.M., the petitioner along with other co-accused persons entered the house of the informant and shot dead the father and the uncle of the informant. On being exhorted by Sita Devi, Amal Kishore Singh and Nawal Kishore Singh fired on the chest of Pappu Kumar. The co-accused Dilchan Singh and

Patna High Court CR. MISC. No.70411 of 2025(2) dt.01-12-2025 2/3 Raushan Singh fired on Dhananjay Singh, who died on the spot.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner rather the specific allegation of firing is against the co-accused Amal Kishore Singh and Nawal Kishore Singh. Nothing incriminating material has been recovered from the conscious possession of the petitioner. There is land dispute between the parties. Similarly situated co-accused person has already been granted bail by this Court vide order dated 24.07.2023 passed in Cr. Misc. No. 40209 of 2023. The petitioner has got clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 15.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Beldaur P.S. Case No. 178 of 2021, with a condition;-

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
