JUSTICE BIRENDRA KUMAR ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State. The petitioner is apprehending her arrest in a case registered for the offences punishable under Section 292 of the Indian Penal Code and Sections 66(e)/67(a) of the I.T. Act. According to FIR, the informant had affairs with her neighbour Rahul Kumar. Later on, Rahul Kumar married with another lady and started some photographs of Rahul Kumar and informant as well as sister of the informant posting on the social media just to tarnish the image of the informant. Allegation is that the petitioner, who is Bhabhi of Rahul Kumar, was also indulged in the act of Rahul Kumar. Learned counsel for the informant opposed the prayer for bail stating that even protest petition has been filed by the
Patna High Court Cr.Misc. No.68734 of 2018(2) dt.17-12-2018 2/2 informant and he is ready to produce necessary material through counter affidavit.
Considering the nature of allegation against the petitioner as well as the fact that she is a female, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Kasim Bazar Police Station Case No.195 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
