ANJANA MISHRA ORAL ORDER 29-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 16.07.2016, in connection with Sessions Trial 67 of 2018 arising out of Puranhiya P.S. Case No. 49 of 2016 for the offences under Sections 25(1-b)a, 25(1-A), 26(ii), 35 of the Arms Act. Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner. It is further submitted that two other co-accused, namely, Aditya Kumar Trivedi and Vijay Kumar have been extended the privilege of regular bail vide orders dated 25.11.2016 in Cr.Misc. No. 48017 of 2016 and 04.02.2017 in Cr.Misc. No. 2565 of 2017 respectively.

Considering the aforementioned facts and

No.75605 of 2019(3) dt.29-11-2019 2/2 circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge, Sheohar, in connection with Sessions Trial No. 67 of 2018, arising out of Puranhiya P.S. Case No. 49 of 2016.
