2. On the last date in the matter i.e. on 03.04.2025 also no one appeared in the Chambers proceeding and by way of last indulgence, the matter was put up on 06.05.2025. The matter is thus being heard on merits.
3. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Although other family members were also made accused in the complaint petition, the cognizance
Patna High Court CR. MISC. No.72632 of 2023(7) dt.06-05-2025 2/3 has only been taken under Section 498A of the IPC against the petitioner only.
4. The prosecution case is based upon a complaint filed by the opposite party no. 2 in which she has made an allegation of demand of dowry and torture. Petitioner is the husband of opposite party no.2.
5. Learned counsel for the petitioner submits that the allegations levelled in the complaint are not correct and the same has been filed on the provocation of her father. As a matter of fact, the parents of the complainant want that the petitioner should live with them after leaving his parents to which the petitioner is not agreeable. It has also been brought to the notice of the Court that the complaint case was lodged by the petitioner bearing Complaint Case No. 266 of 2022 on 23.08.2022 against the complainant and her family members of assault, theft and wrongful confinement. The said complaint is annexed as Annexure-3 of the present case. The attention of this Court has also been drawn towards the statement made in paragraph-11 of the said petition that the petitioner is still ready to keep his wife full honour and dignity.
6. In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or

No.72632 of 2023(7) dt.06-05-2025 3/3 surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with C.R. No. 1151 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S., and subject to the further condition that the petitioner shall cooperate in the investigation/trial.
