JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 The petitioner seeks regular bail in connection with Bhorey P.S. Case No. 263 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302, 436, 504 of the Indian Penal Code.
Allegation as per F.I.R. is that petitioner along with several other accused persons came variously armed and made indiscriminate firing and there is specific allegation against one Lal Bahadur Yadav fired at sister in law (bhabhi) of the informant causing her death.
It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner rather the specific allegation against co-accused Lal Bahadur Yadav, who fired on the deceased. Further he has been in
Patna High Court Cr.Misc. No.68539 of 2018(2) dt.30-11-2018 2/2 judicial custody since 25.07.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XII, Gopalganj, in connection with Bhorey P.S. Case No. 263 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
