JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 Petitioner prays for bail in connection with Kateya P.S. Case No. 188 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation as per FIR is that informant received an information of murder of her husband and went there and saw his dead body.

Submission of learned counsel for the petitioner is that he is not named in the FIR and in the confessional statement of co-accused he has been named and he is in custody since 16.6.2018.

Heard learned APP and perused the impugned order from which it appears that during investigation in paragraph-9 of the case diary one witness has taken the name of the

Patna High Court Cr.Misc. No.68086 of 2018(2) dt.30-11-2018 2/2 petitioner that he had seen the petitioner near the dead body with service revolver.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.
