The petitioner is apprehending his arrest in connection with Pupri P.S.Case No.246/19 registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per FIR, petitioner leaving a bag succeeded in fleeing away and from that bag there is recovery of 7.50 ml. of liquor. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and having no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of

Patna High Court CR. MISC. No.64549 of 2019(2) dt.15-10-2019 2/2 with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

With the aforesaid direction, this application is disposed of.
