The petitioner seeks bail in Sadar P.S. Case No. 367 of 2018 instituted for the offence under Sections 365, 366(A) and 34 of the Indian Penal Code.
In the written report it is alleged that Raushan Kumar used to come to meet daughter-in-law of the informant. It is alleged that Raushan Kumar in conspiracy with four other accused persons as mentioned in the written report has kidnapped daughter-in-law of the informant.
Counsel for the petitioner submits that petitioner is Samdhi of the informant. The daughter of petitioner was married with son of the informant. Counsel for the petitioner
Patna High Court Cr.Misc. No.70736 of 2018(2) dt.04-12-2018 2/2 further submits that initially name of petitioner was mentioned in the witness column but subsequently his name has also been incorporated in accused column at item No. 5. Counsel for the informant has appeared and opposed the prayer for bail.
Petitioner is said to be in custody since 16.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Sadar P.S. Case No. 367 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
