2. The petitioner seeks bail in connection with Silao P.S. Case No. 359 of 2023 registered for the offence punishable under Sections 363/365 and during investigation, section 364/302/201/120 (B) of the Indian Penal Code added.

3. As per the prosecution case, the deceased was kidnapped and killed by the accused persons because he was in relationship with a lady, Ashmita Kumari. Initially, they made him unconscious and thereafter they gave him an injection of Dilona and subsequently killed him.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 18.12.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. The petitioner has been named in the self inculpatory statement of all the co-accused persons. The statement of all the co-accused persons is same and similar.

7. Considering the serious nature of the crime and the materials available on record and the fact that the deceased has been killed because he was in a relationship with Ashmita Kumari, I am not inclined to grant bail to the petitioner and therefore, the present bail application is hereby rejected.
