JUSTICE SHIVAJI PANDEY ORAL ORDER 21-08-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Pirbahore P.S. Case No.292 of 2016, registered for the offence punishable under Sections 341, 323, 188, 353, 504 and 506 of the Indian Penal Code. The principal of the Medical College has lodged an F.I.R. that in terms of the order of the Patna High Court he has directed that all the staffs will come in time in the office with proper dress. The petitioner came late in the hospital without proper dress. When the principal asked him why he has violated the direction, the petitioner picked up a dispute and misbehaved with him and other doctors.

There is case and counter case from both the sides. In paragraph no.38 of the case diary, many things have been said and prima facie it appears that allegation made against the petitioner is not very much correct.

Looking to the aforesaid facts and circumstance of the case, let the petitioner-Dr. Alok Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No.292 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
