The petitioner apprehends his arrest in connection with Excise Complaint Case No. 92 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. It is further submitted that the vehicle in question from where the recovery of illicit foreign liquor has been made, had already been sold to the co-accused Satyendra Kumar for a sum of Rs. 2 lacs and the co-accused Satyendra Kumar himself accepted this fact in his confessional statement but due to non-transfer of name in
Patna High Court CR. MISC. No.7725 of 2023(2) dt.29-03-2023 2/2 records, the name of the petitioner has been dragged in this case. The petitioner has got no criminal antecedent. Having considered the facts and circumstances of the case as well as the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional District and Sessions Judge-V, Banka in connection with Excise Complaint Case No. 92 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
