In this case, the petitioner is seeking regular bail in connection with Sessions Trial No. 763 of 2022 arising out of Barh P.S. Case No. 337 of 2021, registered for the offences punishable under Sections 364 and 120 (B) of the Indian Panel Code.

As per allegation, the petitioner and other accused persons had kidnapped the husband of the informant with intent to kill him.

Learned counsel for the petitioner has submitted that the petitioner is under custody for one and half years and on similar allegation co-accused Pappu Kumar and Nitish Kumar

Patna High Court CR. MISC. No.68819 of 2022(2) dt.15-03-2023 2/2 have been granted bail by the coordinate Bench of this Court. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 337 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the trial and shall be physically present on each and every date before the trial court and in case of failure on two consecutive dates, the learned court below will be at liberty to cancel the bail bonds of the petitioner.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
