2. The petitioners seek bail in connection with Sheikhpura P.S. Case No. 72 of 2025 dated 07.03.2025 instituted for the offence punishable under Sections 137(2), 140(3), 3(5) of Bhartiya Nyaya Sanhita, 2023.

3. The allegation, as made in the F.I.R. is that four unknown persons kidnapped the son of the informant when he went out from his rented house.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. Learned counsel for the petitioners further submits that F.I.R. has been lodged against unknown persons. Only on the basis

Patna High Court CR. MISC. No.70137 of 2025(3) dt.10-12-2025 2/2 of confessional statement of co-accused, Rohit Kumar, the petitioners have been made accused in this case. It is further submitted that co-accused Rohit Kumar was apprehended along with the victim boy on the date of occurrence and the police recovered the victim boy from the possession of Rohit Kumar. It is also submitted that co-accused Rohit Kumar has been granted bail vide order dated 01.09.2025 passed by co-ordinate Bench of this Court in Criminal Miscellaneous No. 34474 of 2025. Lastly, it has been submitted that the petitioners are in custody since 02.08.2025 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioners.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 72 of 2025.
