2. The petitioner is in custody registered for the offence under Sections 406, 418, 419 and 420 of the Indian Penal Code.

3. As per allegation in the FIR, petitioner inducing himself as IB Officer assured the informant to pass a loan from any bank on reference of his post. Since then the informant has paid more than Rs.15,00000/- in the bank account of the petitioner.

4. Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next

Patna High Court CR. MISC. No.73931 of 2023(4) dt.20-03-2024 2/2 submits that the case is purely of civil nature and petitioner has got clean antecedent as stated in para-3 of the petition and petitioner is in custody since 12.06.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

From perusal of the first information report, case diary and the impugned order dated 12.09.2023, it appears that total Rs.8,00,000/- has been taken by the petitioner and Rs.50,000/- has been returned back to the informant by the petitioner and petitioner is in custody since 12.06.2023, in these circumstances, let the petitioner, above named, be directed to be released on bail in connection with Kotwali P.S. Case No.444 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna. (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
