JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Sheohar P. S. Case No. 113 of 2019, disclosing offences under Sections 302 and 306 of IPC.

As per F.I.R. there is allegation that husband of the informant has illicit relationship with the petitioner, due to which, he killed his two sons and also by locking himself and children in the room.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and except that there is illicit relationship, there is no other overtact for abatement in committing suicide by the husband of the deceased. On the other hand, it has come that due to taunting by the informant, the occurrence took place.

Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Sheohar, in connection with Sheohar P. S. Case No. 113 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition to co-operate in the investigation.
