2. The petitioner seeks bail in connection with Udwantnagar P.S. Case No. 149 of 2022 registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the deceased was killed by unknown criminals.

4. One Atul Bihari Pandey @ Atul Pandey @ Nikhil Pandey has confessed his guilt and has named the petitioner. Learned counsel further submits that similarly situated coaccused, namely, Atul Bihari Pandey @ Atul Pandey @ Nikhil Pandey has been granted bail by a co-ordinate Bench of this Court vide order dated 28.08.2023 in Cr. Misc. No. 31412 of

Patna High Court CR. MISC. No.78282 of 2023(3) dt.29-02-2024 2/2 2023. The petitioner is in jail since 22.11.2022.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwantnagar P.S. Case No. 149 of 2022.
