2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a), 32(2), 41(1), 41(2) of Bihar Prohibition and Excise Act, 2018 and sections 25(1-b)a, 26 and 35 of Arms Act.
3. As per prosecution case, 1103.25 litre of Indian made foreign liquor, one country made pistol with cartridges were recovered from a truck and house of co-accused Pankaj Singh.
4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of the vehicle in question. The name of the petitioner transpired in this case on the basis of disclosure made by apprehended co-accused persons. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the
Patna High Court CR. MISC. No.70468 of 2025(2) dt.19-12-2025 2/2 bail application.
6. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise 1, Samastipur in connection with Bibhutipur P.S. Case No. 228 of 2025, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023.
