The petitioner seeks pre-arrest bail in connection with Nautan P.S. Case No. 241 of 2019 registered under Sections 363, 366A and 34 of the Indian Penal Code.

The accusation is kidnapping of minor daughter of the informant by Abhishek Kumar with the help of Neetesh Kumar, Ram Lal Mahto and Tara Devi.

The learned counsel appearing on behalf of the petitioner submits that it would appear from the first information report that allegation of kidnapping of minor daughter of the informant is against Abhishek Kumar. The name of the petitioner and two others have been detailed by the informant having hand in the kidnapping of her daughter. The statement of the victim-girl under Section 164 of the Criminal

No.67332 of 2019(2) dt.14-11-2019 2/2 Procedure Code has been recorded on 24.07.2019 in which she has stated that she left the house in company of Abhishek Kumar, reached at Bettiah Railway Station, from where both went to Ahmadabad and started to live in a room and performed the marriage in a temple on 25.06.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Nautan P.S. Case No. 241 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
