2. The petitioner seeks bail in connection with Saur Bazar (Patar Ghat O.P) No. 151 of 2024 registered for the offences under Section 302 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is alleged to have assaulted the victim on his head because of which he died.

4. Learned senior counsel for the petitioner has submitted that no one has seen the occurrence and the petitioner is not involved in the killing. The daughter of the victim is not an eye witness and the informant is also not an eye witness. The petitioner is in jail since 21.02.2024.

5. Learned APP for the State has opposed the

Patna High Court CR. MISC. No.74600 of 2024(2) dt.23-10-2024 2/2 prayer for bail by contending that the petitioner had assaulted the deceased on his head and when people went there, the petitioner started running away but he was caught by the persons on the spot.

6. Considering the fact that the petitioner is the assailant of the deceased, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest. , (Sandeep Kumar, J) Harshita/- U T
