Petitioner seeks bail in Rasulpur P.S. Case No.105/18 registered for the offence punishable under Sections 341, 323, 324, 307, 504, 506, 447 and 34 of the Indian Penal Code. The informant has stated that when he was milking the cow in the morning at his door, the accused persons including the petitioner reached there and started to abuse the brother of the informant, Sri Kishun Yadav and his son, Subash Yadav. Thereafter, all the accused persons assaulted them with knife and Khanti due to which they sustained grievous injury and fell down on the ground. Thereafter, the injured persons were taken to PHC from where they were referred to the P.M.C.H., Patna for better treatment.

Considering the aforesaid facts and circumstances of the case

Patna High Court Cr.Misc. No.68901 of 2018(3) dt.13-12-2018 2/2 and also in view of the fact that the there is direct allegation against the petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the petitioner is granted liberty to renew his prayer for bail after completing one year in jail custody. (S. Kumar, J) Sanjay/- U T
