====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with S.Tr. No. 409 of 2024 arising out of Baniyapur P.S. Case No. 495 of 2023 registered for the offence under Section 302, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have participated in the murder of son of the informant.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during investigation in confessional statement of co-accused Shyam Sundar Sah. He further submits that last witness in this case was examined on 10.01.2025 and thereafter, the trial of the case is pending for the examination of the I.O. and the Doctor.

No.69076 of 2025(2) dt.07-11-2025 2/2 It is further submitted that similarly situated co-accused, namely, Raju Kumar has already been granted regular bail by co-ordinate Bench of this Court vide order dated 25.06.2025 passed in Cr. Misc. No. 38469 of 2025. Petitioner claims clean antecedent and is in custody since 24.11.2023.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 12th Additional Sessions Judge, Saran at Chapra in connection with Baniyapur P.S. Case No. 495 of 2023.
