2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition & Excise Act.

3 . As per the prosecution case , 144 litres of country made liquor was recovered from the spot.

4. Learned counsel for the petitioner submits that name of the petitioner transpired on the confessional statement of co-accused Govind Chaudhary . No incriminating material has been recovered from conscious possession of the petitioner. Petitioner is in custody since 05.09.2024 . Chargesheet has already been submitted.

Patna High Court CR. MISC. No.73352 of 2024(2) dt.20-12-2024 2/2 5 . Learned A.P.P. for the State vehemently opposed the bail application .

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Special Judge Court no. 2 at Buxar in connection with Brahmpur (Chakki OP) P. S. Case No. 360 of 2024 .
