The petitioner seeks bail in connection with Kudhani P.S. Case No. 314 of 2018 instituted for the offence under Section(s) 414/34 of the Indian Penal Code and Section 30(a), 38(i), 41(i) of the Bihar Prohibition and Excise Act, 2016. It is alleged that total 112.320 litres of illicit foreign liquor has been recovered from the newly constructed house of this petitioner.

Learned counsel for the petitioner submits that petitioner has not been arrested on the spot. Petitioner has voluntarily surrendered on 9.10.2018 and since then he is languishing in custody.

Patna High Court Cr.Misc. No.72931 of 2018(2) dt.07-12-2018 2/2 It is mentioned in para 3 of the bail petition that petitioner has been made accused in one another case under the Excise Act.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Kudhani P.S. Case No. 314 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.

The petitioner will file affidavit at the time of filing bail bond that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities, his bail bond in instant case will liable to be cancelled.
