Petitioner seeks bail in connection with Paliganj P.S. Case No. 21 of 2017 registered for the offences under Section 414 of the Indian Penal Code, section 2(e), 3, 5, 7 of the Bihar Excise Mahua Flower Act, 2006 and section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016 . Learned counsel for the petitioner submits that the alleged recovery has been made from the vehicle in question and nothing has been recovered from the conscious possession of the petitioner. Petitioner has been arrested on mere suspicion. Petitioner is in custody since 07.02.2017.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.21245 of 2017 (2) dt.10-05-2017 2/2 case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Danapur in connection with Paliganj P.S. Case No. 21 of 2017.
