====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 18-04-2018 Heard the learned counsel for the petitioner. The petitioner filed petition against the order dated 07.04.2017 by which the learned Principal Judge, Family Court, Gaya rejected the petition of the petitioner for getting his daughter admitted in Manav Bharti National School, Gaya and for keeping her in the hostel.
The learned counsel for the petitioner submits that the wife of the petitioner swore an affidavit that she is ready to give the custody of her daughter to her husband but it appears that affidavit has not been filed from the side of the petitioner. The petitioner did not seek custody of the child. The mother was willing to get the child admitted in the school as a day scholar on
Patna High Court C.Misc. No.813 of 2017 (2) dt.18-04-2018 such, the court allowed the prayer of the petitioner to get the child admitted in the school but she would attend the school from the house of her mother.
Therefore, I do not find any illegality or jurisdictional error in the order impugned. Accordingly, this civil miscellaneous petition is dismissed.
