Petitioner seeks bail in Bihpur (Jhandapur) P.S. Case No.08 of 2017 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.

Counsel for the petitioner submits that mere suspicion has been raised against the petitioner.

It is alleged that informant got information from Srijan Yadav that his uncle has been killed by gun shot in Koshi Balora Bahiar. The informant went there and found his uncle dead. It is further alleged that petitioner along with Dharo Yadav and Sushil Yadav of Lattipur Bihpur have committed the offence.

Patna High Court Cr.Misc. No.68946 of 2018(2) dt.29-11-2018 2/2 Counsel for the petitioner further submits that coaccused, Dharo Singh, has already been granted regular bail by co-ordinate Bench of this Court by order dated 28.02.2018 passed in Cr. Misc. No.11498 of 2018.

Petitioner is in custody since 05.06.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, Naugachia, Bhagalpur, in connection with Bihpur (Jhandapur) P.S. Case No.08 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
