JUSTICE RAKESH KUMAR ORAL ORDER 26-07-2017 Heard Sri Shivendra Prasad, learned counsel for the petitioner. None appeared on behalf of the State. The petitioner has prayed for grant of bail, in the event of his arrest or surrender in Tekari P.S. Case No.302/2016 registered for the offence under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

It was submitted by learned counsel for the petitioner that there was case and counter case in between the parties and the informant side of the present case were aggressor in the occurrence. He submits that the petitioner had also received severe injury. However, in the F.I.R. there is specific accusation against the petitioner that he gave rod blow on the head of Uday Singh.

Patna High Court Cr.Misc. No.21842 of 2017 (3) dt.26-07-2017 2/2 Considering the fact that there is specific accusation against the petitioner in the F.I.R., I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.

However, it is observed that if within six weeks from today, the petitioner appears before the court below and makes a prayer for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.
