From Annexure-3, letter dated 01.10.2019 issued by the Civil Surgeon-cum-Chief Medical Officer, Vaishali at Hajipur, it appears that there is no details available for the petitioner's posting in the said period and that the services were not certified for the said period with reference to any document showing his posting anywhere.

It is submitted by learned counsel for the petitioner

Patna High Court CWJC No.1309 of 2023(2) dt.20-06-2023 2/2 that he had responded to the show-cause dated 01.10.2019 by reply dated 06.10.2019 (Annexure-3/1).

Since the show-cause is pending consideration before the Civil Surgeon-cum-Chief Medical Officer (Respondent No. 5), there is no issue arising today for adjudication in the instant proceedings as final decision has to be taken by Respondent No. 5 with reference to the records of the petitioner's services for the relevant period.

Application is therefore not required to be kept pending and is disposed of, however with direction to Respondent No. 5 (The Surgeon cum Chief Medical Officer) to take a final decision within three months form the date of receipt/production of a copy of this order. If any dues are found admissible, the respondent would be obliged to ensure payment of dues within four weeks thereafter.
