JUSTICE SANJAY PRIYA ORAL ORDER 3/ 25-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek bail in Mahila P.S. Case No.09 of 2017 instituted for the offence under Section(s) 506, 509, 354A, 354-B, 500, 501/34 Indian Penal Code and Sections 66-A, 66-B and 67 IT Act.

As per written report, petitioner No.1 in conspiracy with petitioner No.2, used to send vulgar photograph of the daughter of the informant on Whatsapp and Face Book, when marriage of daughter of the informant, could not be performed with petitioner No.1, who wanted to marry her. It has been submitted that petitioner No.2 is Mausa of petitioner No.1.

Patna High Court Cr.Misc. No.22206 of 2017 (3) dt.25-05-2017 2/2 Case diary has been received.

Counsel for the petitioners submits that there is no material in the case diary to substantiate the aforesaid allegation against the petitioner.

The learned APP has stated that there is general allegation against the petitioners in the case diary as mentioned in the written report.

Petitioners are said to be in custody since 17.03.2017. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Gaya, in connection with Mahila P.S. Case No.09 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioners.
