JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2017 Heard Sri Sheo Kumar Prasad, learned counsel for the petitioner and Sri Ram Sumiran Roy, learned Additional Public Prosecutor .

The petitioner, apprehending his arrest in Nardiganj P.S. Case No. 10 of 2017 registered for the offence under section 30(a) of the Bihar Excise (Amendment )Act, 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been made accused on an accusation that petitioner was holding a bag containing some pouches of country made liquor as well as two bottles of Indian make foreign liquor , however after noticing Police , it was alleged that petitioner fled away. He submits that it is a false case and nothing was recovered

Patna High Court Cr.Misc. No.21806 of 2017 (2) dt.01-07-2017 2/2 from the possession of the petitioner.

Considering the nature of accusation , in the event of arrest or surrender within a period of six weeks from today, let the petitioner Karu Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada / concerned court in connection with Nardiganj P.S. Case No. 10 of 2017 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure 1973.
