JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 The petitioner seeks bail in connection with Birpur P.S.Case No. 38 of 2018 registered under Sections 147,148,149,302,323 and 341 of the Indian penal Code. Allegation against the petitioner and several other accused persons is of assaulting the son of the informant with Lathi, Danda, rod and Khanti and later on, he succumbed to the injuries.

Submission of learned counsel for the petitioner is that seven persons are named in the FIR but no specific allegation has been attributed against them or the petitioner and petitioner is in custody since 03.05.2018.

Heard learned APP also as well as learned counsel for the Informant. They have opposed the prayer of bail stating that post-mortem report shows five injuries on the person of the

Patna High Court Cr.Misc. No.69079 of 2018(2) dt.03-12-2018 2/2 deceased and there is allegation of assault against the petitioner and several other co-accused persons.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1st, Begusarai in connection with Birpur P.S. Case No. 38 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
