JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 Petitioner prays for bail in connection with Sikraul P.S. Case No. 50 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 and later on Section 302 of the Indian Penal Code was added. Allegation as per FIR is that in a dance programme during marriage some miscreants came and assaulted son of the informant and there was also allegation of snatching cash and golden locket from him and several persons have been named in the FIR.
Submission of learned counsel for the petitioner is that there is no allegation against the petitioner and he is in custody since 11.9.2018 and co-accused has already been granted bail by a the then co-ordinate Bench of this Court vide order dated 10.7.2018 in Cr.Misc.No. 41280 of 2018.
Patna High Court Cr.Misc. No.69110 of 2018(2) dt.03-12-2018 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Buxar, in connection with Sikraul P.S.Case No. 50 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
