Petitioners are apprehending their arrest in Jamui Mahila P.S. Case no. 84 of 2016 for the offences registered under Sections 323, 341 and 498A/34 of the Indian Penal Code. It is alleged that petitioners demanded dowry of Rs. 1 lac from the informant and due to non-fulfilment of the same she was assaulted and as a result she miscarried her pregnancy. Ultimately her parents took her to their home. It has been contended on behalf of the petitioners that

Patna High Court Cr.Misc. No.22588 of 2017 (2) dt.01-06-2017 2/2 all the petitioners have got no criminal antecedent. Petitioner no. 1 is mother-in-law, petitioners no. 2 and 3 are elder brothers-inlaw and petitioners no. 4 and 5 are elder sisters-in-law of the informant. They are separate in mess and property from the husband of the informant. Petitioners have falsely been implicated in the present case. The allegation of miscarriage is false and there is no injury report in this regard.

Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Jamui, in Jamui Mahila P.S. Case no. 84 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
