The petitioners apprehend their arrest in connection with N.T.P.S. Case No. 47 of 2019 registered under Sections 341, 323, 504 and 307/34 of the Indian Penal Code. The accusation is that informant, Raju Yadav, had gone to his Sasural at village Sahnaura, where his mother-inlaw, Shaila Devi, was engaged in construction the house. In the meantime, petitioners and Nitish Kumar started to abuse to his mother-in-law and cause assault and also stopped the construction work. When the informant made protest then he

Patna High Court CR. MISC. No.64262 of 2019(2) dt.22-10-2019 2/2 was abused and assaulted by them. At that time, Nitish Kumar gave iron rod blow at his head.

Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific specific overt act has been attributed against the petitioners. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned J.M. Ist Class, Barh, Patna, in connection with N.T.P.S. Case No. 47 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
