====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 08-10-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek regular bail in a case registered under Section 30(a) of Bihar Prohibition and Excise Act and Sections 274, 275, 317(2) and 3(5) of Bharatiya Nyaya Sanhita.

3. As per the prosecution case, 200 litres of illicit liquor was recovered from two motorcycles and petitioners were arrested on the spot.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Further submission is that petitioners were passersby and only on suspicion, they have been arrested. Petitioners were not

Patna High Court CR. MISC. No.68960 of 2025(2) dt.08-10-2025 2/2 riding the seized motorcycles and the same do not belong to the petitioners. There is no independent witness on the seizure list. Petitioners are young boys having no criminal antecedent and they are in custody since 31.08.2025. There is no chance of their absconding or tampering with the evidence. Petitioners undertake to cooperate in the investigation and trial.

5. Learned A.P.P. for the State has opposed the prayer for regular bail of the petitioners.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Raghopur P.S. Case No. 234 of 2025.
