====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2020 Heard learned counsel appearing for the petitioner and learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner apprehends his arrest in connection with Roh P.S. Case No. 120 of 2019 registered for the offences punishable under Sections 341, 342, 323, 307 and 504 of the Indian Penal Code.
Petitioner happens to be son of the informant and it appears from perusal of the F.I.R. of the informant that due to property dispute the alleged occurrence took place, however, except Section 307 of the Indian Penal Code almost all the Sections are bailable in nature. Paragraph 12 of the Case Diary goes to show that two injuries were found on the person of the informant but both the aforesaid injuries were simple in nature and said to be caused by hard and blunt substance. Patna High Court CR. MISC. No.63604 of 2019(6) dt.29-06-2020 2/2 Court granted time to parties to compromise the dispute but, there is nothing on the record to show that any settlement has taken place between the parties.
However, considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and the above named petitioner in the event of his arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri. Prasant Kumar, J.M. Ist Class, Nawada in connection with Roh P.S. Case No. 120 of 2019 subject to conditions as laid down under Section 438 (2) of the Cr.P.C.
