The petitioner apprehends his arrest in connection with Dighwara P.S. Case No. 187 of 2019, registered under Section 307 and other allied Sections of the Indian Penal Code. The accusation is that in the noon of 06.07.2019, petitioner and Ameer Hussain having Garasa and iron rod and Anwari Anjum having stick in their hand came at the door of the informant, Maksud Mian, and started to abuse. When he made protest then petitioner assaulted through Garasa causing injury at his shoulder and head.
Learned counsel for the petitioner submits that due to family dispute, hot talk was exchanged in between the
Patna High Court CR. MISC. No.64468 of 2019(2) dt.24-10-2019 2/2 petitioner and the informant but with ulterior motive, the present case has been lodged with false allegation. Moreover, the injuries, as found on the person of informant, are simple in nature. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Saran at Chapra, in connection with Dighwara P.S. Case No. 187 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
