Mr. Jai Narain Thakur Mr. Ratnakar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.

30-11-2018 Heard Sri Kishore Kunal, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Ratnakar Jha, learned counsel for the informant. The sole petitioner, who is in custody since 18-08-2018 in Jaynagar P.S. Case No. 87 of 2014 registered for offence under Sections 406, 420, 120(B), 467 and 471 of the Indian Penal Code, has prayed for grant of bail, primarily on the ground that some of the other co-accused have been granted bail and also on the plea that though petitioner was arrayed as accused in the F.I.R., it has not been alleged as to whether the petitioner was Director of the agency or not. Learned counsel for the petitioner submits that there is no material on record, even then, the petitioner was made

Patna High Court Cr.Misc. No.69432 of 2018(2) dt.30-11-2018 2/2 accused.

Fact remains that it was a case of cheating of general public. Though, F.I.R. was lodged in the year 2014 and in F.I.R., petitioner was arrayed as accused no. 4, he never earlier took step to appear before the court below for grant of bail. After much delay, he could be arrested in the year 2018 and now, a prayer has been made for grant of bail on the plea that other accused persons have been granted bail, but fact remains that other accused persons were granted bail in the year 2015 and 2017 and as such, at the moment, I am not inclined to grant bail. The prayer for bail stands dismissed.
