03-12-2018 Heard Sri Rabindra Kumar Priyadarshi, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 07-09-2018 in Barachatti P.S. Case No. 590 of 2018 registered for offence under Sections 30(a), 38, 47 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He further submits that the petitioner is a tempo driver and he was carrying one person as passenger on his tempo, however; when his tempo was intercepted and it was searched, about 36 litres of Indian make foreign liquor was recovered. Learned counsel for the petitioner submits that petitioner was not aware
Patna High Court Cr.Misc. No.70730 of 2018(2) dt.03-12-2018 2/2 about the said liquor, only he was carrying one person as passenger.
Be that as it may, considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Chintu Raj @ Lallu Kumar @ Chintu Raj Lallu be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Gaya in connection with Barachatti P.S.
